Purpose and Intended UseThis form is designed to govern the use of equine facilities by on-site trainers, riding instructors and other equine service providers. It covers such topics as arena use, liability, insurance, and compensation for use of the facility. This form is distinguishable from ELS’ equine property lease agreement forms because this form is designed for situations where the equine service provider is not actually renting the property, but simply conducting business on the property.

Use of Facility
- Type of business activities the equine service provider can perform at the facility
- Equine service provider agrees to conduct business in ethical and lawful manner, comply with breed/discipline association rules
- How the facility will be shared, and whether the equine service provider or other users will have priority over arena usage, etc.
- Whether equine service provider can host clinics or competitions, and if so, what restrictions apply
- Equine service provider agree to follow facility rules and ensure that clients and employees follow facility rules
- Whether equine service provider can bring dogs to the facility
- Compensation to be paid to facility (if any), and how it will be calculated (e.g., flat fee, percentage of revenue, or other)
- Penalties for late payment and bounced checks
Liability and Insurance
- Provisions for insurance, including naming facility as an additional insured on equine service provider’s policy
- Equine service provider agrees they have inspected the facility and deem it safe for their use
- Equine service provider required to have all clients, visitors, etc. fill out liability releases provided by facility
- Liability release where equine service provider assumes risk of loss or injury to their horses and their clients’ horses
- Liability release where equine service provider assumes risk of damage to their personal property
- Liability release where equine service provider assumes risk of injury or death to themselves
- Liability release where equine service provider assumes risk of trail riding and other types of riding outside of arenas
- Indemnification provision where if facility is sued as a result of equine service provider’s use of property or by equine service provider’s clients, equine service provider agrees to pay facility’s legal fees and the cost of any legal judgment
